A lawsuit over a drowning death in the city of South Haven is being taken up by the Michigan Supreme Court.

The case centers on whether a city can be held liable in such situations.

The Michigan Court of Appeals found last year the city is protected by governmental immunity in the death of an 18-year-old in 2020 and dismissed the suit, but according to MLive, the state high court now says it will consider the matter. It’s directed both sides to focus their arguments on whether the appeals court was correct.

The high court now has a few options. It can affirm the earlier ruling, overturn it, or provide a new legal interpretation. During earlier proceedings, attorneys debated not only responsibility for the incident but also how the city uses money generated from its beach operations.

Before reaching the Court of Appeals, a lower court had already ruled that South Haven was immune from the lawsuit.
